This article aims to address various issues that arise from the interpretation and application of the institute "constitution of an accused". This is important because it directly affects the effective acquire of the defendant's right of defense. In this sense, the article examines the interaction between the consequences of acquiring procedural quality accused in the context of the real protection of the accused's interests and the European legal protection concept.
